Damage Waiver Agreement

Houston Mobility Scooter Rentals · Addendum to the Rental Agreement

The short version

1. Purpose

This Damage Waiver Addendum (the “Addendum”) is part of the Rental Agreement between Houston Mobility Scooter Rentals (“Company”) and the renter named in the booking (“Renter”). It is optional. If Renter accepts it by adding it to the booking and paying the fee, Company agrees to limit Renter’s financial responsibility for certain accidental damage to the rented scooter, as described below.

2. Fee

The Damage Waiver fee is $35.00 per scooter. The fee is charged at the time of booking, covers the scooter and its accessories, is due in addition to the rental rate and applicable tax, and is non-refundable once the rental begins.

3. What Is Covered

If Renter accepts the Damage Waiver, Company waives Renter’s responsibility for the cost to repair or replace the following scooter components when they are accidentally damaged during the rental period, subject to the Deductible in Section 4:

4. Deductible

If damage covered by this Addendum is found, Renter will pay a $50.00 deductible for non-electrical parts (such as the seat and armrests) or a $175.00 deductible for motorized parts (such as the motor, controller and steering column) per incident. If the repair costs less than the applicable deductible, Renter pays only the actual cost. Company will then cover the remaining reasonable cost of repair or replacement of the covered components. The deductible is due after Company has inspected and assessed the damage, and Company may charge it to the payment method on file.

5. What Is Not Covered

This Addendum does not cover, and Renter remains fully responsible for:

6. Renter’s Responsibilities

Renter agrees to: (a) operate the scooter according to the instructions provided; (b) store and charge the scooter indoors, away from water; (c) notify Company promptly, and no later than the time of return, of any damage or malfunction; (d) not attempt repairs; and (e) return the scooter and all components, including the key and charger, at the agreed time and place. Company documents the condition of the scooter, with photographs, at delivery and at return, and Renter agrees those records may be used to assess damage. If the scooter is lost or stolen, Renter must notify Company immediately and file a police report within 48 hours, and must give Company a copy of the report.

7. Assessment of Damage

Company will inspect the scooter upon return and determine, in its reasonable judgment, whether damage exists, whether it is covered by this Addendum, and the cost to repair or replace it. Damage that is not covered will be billed to Renter at Company’s actual cost of repair or replacement. Renter authorizes Company to charge the payment method on file for any amount owed under this Addendum. Charges are billed after the rental ends, and rental fees already paid are not credited toward the Deductible or any other amount owed.

8. If Renter Declines the Damage Waiver

If Renter declines the Damage Waiver, Renter is responsible for the full cost of repair or replacement of any damage to the scooter during the rental period, up to its replacement value, in accordance with the Rental Agreement. The same applies to any loss, theft or missing accessory, including the key, charger, basket and battery. Replacement costs are:

ItemCost
3-wheel scooter$1,750
4-wheel scooter$2,000
Key$25
Charger$150
Front basket$50
Cup holder$20
Cane holder$30
Battery pack$200
Extended battery$300

9. General Terms

10. Acceptance by Purchase

No signature is required. Renter accepts this Addendum and enters into this agreement by adding the Damage Waiver to the booking and paying the $35.00 fee per scooter. Payment of the fee is Renter’s agreement to all terms of this Addendum. A copy of this Addendum is available on this page at any time, and by request at info@houstonmobilityscooterrentals.com. If Renter does not add the Damage Waiver to the booking, Section 8 applies.
